Od roku 2003 platí v USA zákon, který zakazuje propagovat, distribuovat nebo vytvářet materiál, který by navozoval pocit, že sledujete dětskou pornografii. To znamená, že videa vzniklá v USA, ve kterých je dvacetiletá slečna s copánky a s plyšovým medvídkem a provádí na kameru nepřístojné věci, jsou ilegální a tvůrce i distributor kvůli nim mohou být obviněni z kriminálního činu. K nejvyšším soudům se ale v Americe dostaly i filmy, ve kterých dochází s pohlavními styku nezletilých, a na které by teoreticky mohl platit stejný zákon. Bushova administrativa sice tvrdí, že zákon se nevztahuje na mainstreamové filmy a rozeznává rozdíl mezi nimi a ilegální dětskou pornografií, ale problém je, že v platném zákoně žádný takový dodatek nefiguruje. Paul Clement, právník Bushovy administrativy k problému řekl: „Pokud bereme v úvahu filmy jako Traffic nebo Americká krása, není se čeho obávat."
Ve snímku Traffic je scéna, ve které se nezletilá dcera jedné z postav oddává sexu se svým drogovým dealerem. Snímek Lolita zase zobrazuje posedlost muže k mladičké nezletilé dívce, se kterou má nakonec i sex. V Americké kráse zase dvaačtyřicetiletý muž fantazíruje o kamarádce své dcery, která chodí na střední školu. V Titanicu je zase ústřední milostná zápletka, ve které figurují dva mladí lidé. Proč se vůbec takový nesmysl dostal k nejvyššímu soudu? Jednoduše proto, že vládní opozice chce zrušení velmi přísného zákona a tak upozorňují na jeho nedokonalost. I ve velkých hollywoodských filmech jsou totiž scény, které zobrazují sex nezletilých a dal by se tedy na ně zákon jednoduše také aplikovat.
Této díry v zákoně začínají ovšem využívat také obhájci skutečných lidí zadržených za dětskou pornografii. V roce 2004 byl zatčen muž z Floridy, který se přes internetový chat bavil s mladou nezletilou dívkou a lákal jí na sex. Ona dívka na druhé straně byl ale ve skutečnosti agent FBI, který muže nakonec zatkl. Jeho obhájce teď upozorňuje na to, že i ve filmech jako je Lolita je zobrazován sex mezi dospělým mužem a nezletilou dívkou, a že zákon by měl být aplikován na každého stejně. „Váš klient ale nenatáčel Lolitu," upozornila obhájce soudkyně u soudního přelíčení. Původní verze amerického zákona mimochodem obsahovala i zákaz zobrazení dětské pornografie pomocí počítačové animace či na počítači vytvořených obrázcích. Tato část však byla před podepsáním prezidentem ze zákona nakonec vyjmuta.
